Electronic Commerce Notice

This notice is provided under the Turkish Law No. 6563 on the Regulation of Electronic Commerce (ETDHK) and its secondary legislation. It explains who the service provider is, what activities the service covers, how commercial electronic messages are handled, and how to file complaints relating to electronic commerce.
Service provider
Service provider: the Out of Ten team. Until the operating legal entity is registered, the provider can be reached at agdemirhalim4@gmail.com.
ETBİS registration: the service is not yet registered with the Electronic Commerce Information System (ETBİS). The registration number will be published on this page once available.
Central registration system number (MERSİS) and trade registry number: will be published here once the operating entity is incorporated.
Scope of service
Out of Ten is a digital service that generates AI-based first-impression scores from photos uploaded by the user. The service is provided through the mobile application distributed on the Apple App Store and Google Play, and through this website.
Digital purchases (one-time reports and the weekly subscription) are processed by Apple App Store and Google Play under their respective rules. We act as the underlying service provider; the seller of record for in-app purchases is the platform operator.
Pre-contract information
Before you complete a purchase you are informed of the following inside the app: the qualifications of the digital service, the total price including taxes, the payment and delivery method, the right to withdraw or the absence thereof for digital content, technical steps required to conclude the contract, language of the contract, and a summary of the obligations created by the contract.
A confirmation message is sent to your account email after each purchase, summarising the order and providing a record of the transaction.
Commercial electronic messages
We do not send marketing emails or push notifications without your prior consent. Transactional notifications (such as 'analysis ready', 'battle invitation', or 'password reset') are sent on the basis of the contract and do not require prior commercial consent.
If in the future we wish to send promotional messages, your consent will be requested through the app, with a clear sender name, the subject of the message, and an unsubscribe option in every message. Consent can be withdrawn at any time through the app or by writing to us, or through the İYS (İleti Yönetim Sistemi) system.
Intermediary content
User-generated content (photos uploaded by you) is processed solely to generate the analysis you requested. We do not host a public marketplace and we do not act as an intermediary platform between buyers and sellers. The AI score that is returned to you is generated by our service and is not third-party content.
Right of withdrawal
For digital content that is delivered instantly (such as an AI analysis report), the statutory right of withdrawal does not apply once performance has begun with your explicit prior consent and your acknowledgement of the loss of that right, in line with Article 15 of the Distance Contracts Regulation.
For subscriptions, you can cancel auto-renewal at any time from your Apple App Store or Google Play account; the cancellation takes effect at the end of the current billing period.
Complaints and dispute resolution
If you have a complaint about the service, please write to us at agdemirhalim4@gmail.com. We respond within fifteen days at the latest.
For consumer complaints, you may also apply to the relevant District or Provincial Arbitration Committee for Consumer Problems (Tüketici Hakem Heyeti) or the Consumer Courts, in line with the monetary thresholds set each year by the Ministry of Trade.
Competent authority
The Ministry of Trade of the Republic of Türkiye is the competent authority for the supervision of electronic commerce service providers. The Ministry can be reached at ticaret.gov.tr.
